Before you can assess whether your AI application complies with the law, it’s important to first understand how you’re using AI. The European AI Act sets clear rules for different types of users and applications.

A manufacturer is a natural or legal person who develops or has an AI system developed, and places it on the EU market or puts it into service under their own name or trademark.

Authorised Representative

An authorised representative is a natural or legal person established in the EU who has been formally authorised by a provider established outside the EU to carry out certain obligations under the AI Act on their behalf.

The authorized representative has a specific set of responsibilities, meaning there are no further questions in the Compliance Scan. These responsibilities will be assessed in the Gap Survey that is relevant to you.

Provider

A provider is a natural or legal person who develops an AI system, or has it developed, with the intention of placing it on the EU market or using it under their own name or trademark, whether for payment or not.

The next few questions are designed to determine which responsibilities are relevant to your role as a provider, and to assess the risk profile of your AI system.

Provider (Dual Role)

You will now proceed with this form as a Provider-Deployer with a dual role

You use an AI system under your own authority, which makes you a deployer. Because you have also put your own name or trademark on the system, changed its intended purpose, or substantially modified it, you take on the obligations of a provider in addition to those of a deployer.

The next few questions are designed to determine which responsibilities are relevant to your dual role, and to assess the risk profile of your AI system. Because the provider obligations are the more extensive of the two, the remainder of this scan treats you primarily as a provider.

It is designed to carry out a limited procedural task.
It is intended to improve the outcome of a human activity that has already been completed.
It is designed to identify decision making patterns or deviations from previous decision making patterns, without replacing or influencing the completed human assessment, and is subject to appropriate human review.
It is intended to perform a preparatory task for an assessment related to one of the use cases listed in Annex III, Section A from the EU AI Act.
